2. Service Orders, Payments & Billing

• All hosting services are billed in advance unless otherwise stated.
• Pricing, billing cycles, and renewal terms are displayed during the order process.
• Failure to pay invoices on time may result in suspension or termination of services.
• Payments are securely processed through authorized third-party payment gateways.

3. Service Provisioning & Activation

• USA Server Hosting provides instant activation for eligible hosting plans after successful payment verification
• Some orders may require manual verification, which can delay activation.

4. Acceptable Use Policy

You agree not to use our services for:

• Illegal activities or unlawful content
• Spam, phishing, malware distribution, or abusive activities
• Hacking, DDoS attacks, or unauthorized access attempts
• Hosting copyrighted material without proper authorization
  

5. Uptime & SLA

• We aim to provide 99.9% uptime as outlined in our Service Level Agreement (SLA).
• Scheduled maintenance, force majeure events, and customer-related issues are excluded from uptime calculations.

6. Customer Data & Backups

• Customers are responsible for maintaining backups of their data.
• USA Server Hosting is not responsible for data loss caused by customer actions, software conflicts, or third-party applications.

7. Technical Support

• Technical support is provided according to the selected hosting plan.
• Support includes assistance with server and network-related issues.
• Third-party software installation or custom development support is not included unless specifically agreed.

8. Security & Network Protection

• We implement standard security monitoring and protection measures for our infrastructure.
• Customers are responsible for securing their own applications, scripts, and website content

9. Suspension & Termination

We reserve the right to suspend or terminate services if:

• Any term of this Agreement is violated
• Payments remain overdue
• User activity threatens network stability, security, or performance

10. Refund Policy

• Refund eligibility depends on the hosting plan and refund terms at the time of purchase.
• Services that are instantly activated may have limited refund eligibility.
• Setup fees and used service periods are generally non-refundable.

11. Intellectual Property

• All website content, trademarks, logos, and materials belong to USA Server Hosting or its licensors.
• You may not reproduce, distribute, or modify any content without written permission.

12. Limitation of Liability

• USA Server Hosting shall not be liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the amount paid by the customer for the affected service during the previous billing cycle.

13. Indemnification

You agree to indemnify and hold harmless USA Server Hosting against claims, liabilities, damages, or expenses arising from your use of the services or violation of these Terms.

14. Governing Law

These Terms & Conditions shall be governed by applicable laws and regulations. Any disputes arising from the use of our services will be subject to the appropriate legal jurisdiction.
